Torrance Daily Breeze, DB 11-51 Ordinance Summary TORRANCE CITY COUNCIL ORDINANCE NO. 3789 Assembly Bill 341 (AB 341), is a State mandate requiring, among other things, that multifamily homes of five units or more have recycling programs provided at their homes. This appears to assume that residents of homes five units or less have access to curbside recycling programs, which is not always the case in Torrance. The Public Works Department provides collection services to all homes of one or two units and to some three and four units, and recycling services are included as part of City service. Private commercial haulers provide collection service to some three and four units and to all units of five and above. For a three or four units home to have the option of City service, the complex must be located where at least 75% of the surrounding homes already receive City service. There are at least eight hundred three and four multifamily homes in Torrance and nearly four hundred of these have City service. As AB 341 is written, it is possible for some three and four unit multifamily complexes in Torrance to not receive an equal level of service nor an equal requirement for service to other multifamily homes, unless the City mandates their inclusion. Therefore, staff has added a new section 43.6.7 to the Torrance Municipal Code (TMC) requiring equal responsibility under the law not withstanding how the State defines multifamily service levels. In addition, the ordinance clarifies and updates some language in the existing TMC. The ordinance updates sections of the code related to hauler reporting to reflect the need for additional information stemming from new recycling requirements. The ordinance also removes an annual reporting requirement that is outdated and no longer used.
