Torrance Daily Breeze, DB 4-35 NOTICE INVITING BIDS PROJECT NO. 1491 Notice is hereby given that the Owner, consisting of one or both of the following described public entities: [X] The City of Carson, California [ ] Successor Agency will receive sealed bids at the office of the City Clerk, City Hall, 701 East Carson St., Carson, California, before and including 12:00 p.m. on MONDAY, APRIL 25, 2016, for: PROJECT NO.: 1491 TITLE: CARSON PARK POOL IMPROVEMENTS At the time designated for receiving sealed bids on said Project, the bids will be publicly opened, examined, and read aloud. All bids must be in writing, must be sealed, and must be plainly marked on the outside: "BID ON PROJECT NO 1491." Any bid received after the hour stated above for any reason whatsoever, will not be considered for any purpose but will be returned, unopened, to the bidder. To be responsive to this Notice, Bids for this project must be presented taking into account the requirements of the existing 2013 Project Labor Agreement in effect for certain projects in the City of Carson. The relevant agreement to be considered by bidders is identified as 2013 Project Labor Agreement in effect for certain projects in the City of Carson, which is included in the Special Provisions, and made part of, the Contract Documents for this project. The bid submitted shall be consistent with the requirements of the existing 2013 Project Labor Agreement in effect for certain projects in the City of Carson, and shall also include a Letter of Assent to the same (sample format is included in the bid documents). Failure to submit such letter shall render the bid non-responsive. Each bidder must submit a bid to the Owner, on standard forms available at the Engineering Services Counter. Said bid is to be accompanied by a cash deposit, a certified or cashier's check, or a bidder's bond, made payable to the Owner, in an amount not less than 10 percent of the total bid submitted. The envelope enclosing the bid shall be sealed and addressed to the Owner, c/o City Clerk, and delivered or mailed to the City Clerk at 701 East Carson Street, Carson, California 90745. The envelope shall be plainly marked in the upper left-hand corner as follows: ATTENTION: CITY OF CARSON, CITY CLERK BIDDER'S NAME AND ADDRESS NUMBER AND TITLE OF PROJECT The successful bidder will be required to furnish a faithful performance bond in the amount of 100 percent of the contract price, and a payment bond in the amount of 100 percent of the contract price, both in a form satisfactory to the Owner's Attorney. The contractor shall at the time of award possess a valid State of California Contractors License, License Class A or B and must subcontract with appropriately licensed specialty contractors to perform the work. The Contractor may, at Contractor's sole cost and expense, substitute securities equivalent to any monies withheld by the Owner to insure performance under the contract. Such security shall be deposited with the Owner, or a state or federally chartered bank as escrow agent, who shall pay such monies to the Contractor upon satisfactory completion of the Contract. The Contractor shall be the beneficial owner of any security substituted for monies withheld and shall receive any accrued interest thereon. Securities eligible for investment shall include those listed in Government Code Section 16430 or bank or savings and loan certificates of deposit. No such substitution shall be accepted until the escrow agreement, letter of credit, form of security and any other document related to said substitution is reviewed and found acceptable by the Owner's Attorney. Pre-Bid Conference and Job Walk: Each prospective bidder is responsible for fully acquainting himself with the conditions of the project, as well as those relating to the construction and labor of the Project, to fully understand the facilities, difficulties and restrictions which may impact the total and adequate completion of the project. An optional pre-bid conference and job walk will be held on Monday, April 18, 2016, from 10:00 a.m. to 11:00 a.m. at Carson Park Pool located at 21436 S. Main St, Carson, CA 90745. Each and every bidder is encouraged to attend the pre-bid job walk. The Contract requires that the Contractor monitor weather forecasts for adverse weather conditions that may impact the project. The Contract requires that the Contractor provide site and facilities protection due to unforeseen weather conditions during the course of the contract. Cost of this protection is included in the bid items. The Contractor is required to provide proof of order that any long lead items have been ordered within 7 days of receiving the Notice to Proceed. Proof of purchase must include confirmation and expected delivery date. Timing: Time is of the essence in this contract and performance within the specified time frames is necessary. Capability to perform within the required time frames will be evaluated and considered. The Owner reserves the right to reject any or all bids and to waive any informality or irregularity in any bid received and to be the sole judge of the merits of the respective bids received. The award, if made, will be made to the lowest responsive bidder. Enhanced Electrical Safety Policy: Bidders are advised that all work on this project shall be conducted in compliance with the requirements in the Enhanced Electrical Safety Policy adopted by the city on February 1, 2011, which are included in the Special Provisions, and made part of, the Contract Documents for this project. Project Labor Agreement (PLA): All interested bidders are advised that the scope of work or a portion thereof that is the subject of this notice inviting bids is covered by the City's master Project Labor Agreement ("PLA"). The successful contracting party, and all of its subcontractors, shall have the obligation to comply with all of the terms of the PLA for all portions of the work which are subject to the PLA. A copy of the PLA is attached to the project specifications and incorporated as Exhibit "J". The successful contracting party, and all of its subcontractors, will be required, as a condition of being awarded an agreement, to deliver an executed letter of assent (as shown in PLA Attachment A) to the City concurrently with the submittal of its bid and again concurrently with execution of any agreement and prior to the issuance of any notice to proceed. Failure to provide the same shall be grounds for deeming the bid non-responsive and/or for summary termination of any agreement or for award of the agreement to some other bidder. Prevailing Wages and Contractor Registration Requirements. Contractor shall comply with the requirements of SB 854. SB 854 requires all contractors bidding on public works projects to register with the DIR and to pay an annual fee. SB 854 requires that contractors and subcontractors must register in order to submit a bid and be awarded a contract. The registration requires contractors to provide the State with evidence of the contractors' compliance with a number of statutory requirements. Bidders are advised that this Contract is a public work for purposes of the California Labor Code, which requires payment of prevailing wages. Owner has obtained from the Director of the Department of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work. These rates will be on file at the Owner's office and they will be made available to any interested party upon request. Each Contractor to who a Contract is awarded must pay the prevailing rates, post copies thereof at the job site and otherwise comply with applicable provisions of state law. Diversion of Recyclable Waste Materials: In support of the Owner's waste reduction and recycling efforts, Contractor will be required to divert all Recyclable Waste Materials to appropriate recycling centers rather than area landfills. For purposes of this requirement, Recyclable Waste Materials shall include asphalt, concrete, brick, concrete block and rock. Contractor will be required to submit weight tickets and written proof of diversion with its monthly progress payment requests. All costs incurred for these waste diversion efforts shall be included as part of each Bidder's Total Bid Price. To the greatest extent feasible, Contractor shall endeavor to employ residents of the City of Carson in the construction of the Improvements required by this Contract.
